[FL][Tampa] what’s my liability?
Good day! Not a current situation, but one that can help me make a decision.
I have two large oak trees in the space between the sidewalk and street. Technically the trees are HOA property, but I have to maintain them. Both have become a danger (according to the arborist) and can be removed. One is close to the house and is raising the sidewalk and its root are significantly lifting the sidewalk and headed towards both the community power and cable utilities as well as the foundation of my house. Pretty convinced I’m going to remove that one.
The second is in question - but it’s right next to a fire hydrant. The question boils down to what is my liability if the roots pierce/break the water main feeding the hydrant. Who pays for the repair if it does? The HOA? The City? or Me?
If it’s Me, I’ll likely remove it. If not, then I’m ok with saving the money and just maintaining the tree.
